Acceptable Use Policy
and Billing Policy
This document
contains two sections. Section I is the 'Acceptable Use Policy'
and Section II is the 'Billing Policy'.
By virtue of
being a client of Pacific Express Networks®, you agree
to abide by the following guidelines, rules, and regulations of
the 'Acceptable Use Policy' and the 'Billing Policy'. Pacific
Express Networks® provides Internet access and web hosting
services subject to the following terms and conditions which constitute
a legal contract between you and Pacific Express Networks. For questions
regarding uncertainty of 'Acceptable Use Policy' and the 'Billing
Policy', please contact Pacific Express Networks for clarification.
If you do not agree to these terms and conditions and do not wish
to be bound by them, you may not access or use our services.
Section
I Acceptable use policy (AUP) Customers are prohibited from:
A). Using Pacific Express Networks services for transmitting,
distributing or storing any material that is, unlawful, obscene,
threatening, abusive, libelous, or hateful, or encourages the conduct
that would constitute a criminal offense, give rise to civil liability,
or Use which violates federal, state or local laws. This includes,
but is not limited to, material protected by copyright, trademark,
trade secret, or any other statute. B). Using Pacific Express
Networks services to transmit unsolicited mass E-mailings or Usenet
postings ("spam"). C). Disrupting any part of the Internet
as a whole or any equipment or system forming part of the Pacific
Express Networks, or any services provided by it. D). Broadcasting
marketing or advertising materials, or otherwise sending information
through Pacific Express Networks network in an intrusive basis to
any user of the network or users and hosts directly or indirectly
connected to the network. E). Establishing unauthorized access
to systems, software, data, to another user's account, or attempting
to circumvent user authentication, security of any host, network
or account ("cracking"). This includes, but is not limited to, accessing
data not intended for the Customer, logging into a server or account
the Customer is not expressly authorized to access, or probing the
security of other networks. F). Any activities that interfere
with the ability of others to use Pacific Express Networks services
or facilities effectively. Any violation of the above mentioned
guideline will result in immediate termination of Customer account,
and possible civil or criminal liability.
Section II
Billing policy: All payments to Pacific Express Networks are
due on the first day on the month. The customer is responsible
for keeping his or her billing information with Pacific Express
Networks up-to-date and accurate. Furnishing false data on the sign-up
form, contract, or online forms, including fraudulent use of credit
card numbers, is grounds for immediate termination, and possible
civil or criminal liability. The resale of Pacific Express Networks
online services is not permitted, unless specifically allowed and
documented in a written agreement. Payments are due on the first
day of each month in advance for the current month, Pacific Express
Networks gives customers ten days grace period for the payment of
amounts due, after the ten days Customer account is considered past-due.
Pacific Express Networks will disable Customer accounts that are
past-due by more than 30 (thirty days). Pacific Express Networks
reserves the right to disable Customer accounts for reasons of erratic
payments, or Customer accounts that have a history of more than
6 (six) past-due statement or billing months in a 12 (twelve) consecutive
months period.
